USADA Motions to Quash Pacquaio request to subpoena FMJ Medical Records

    Actually a VERY GOOD POINT. Pac' (TR) lawyers may know that the can't get these but it now turns the whole issue around. Now May will be seen as a doper if he doesn't release these because he is hiding something. I LOVE IT! See Arum's comments in the Nonito transcript on the front page. :rofl

    All ready saw this. I think this is the best PR stunt Arum has pulled in a long time. He is making it look as if it is Floyd that is hiding something. :rofl

    Are you sure that's true? How many athletes get tested all year by USADA but when a World Championships or Olympics happens, they get found out by the exact same testing procedure?

    Is this is a coincidence or is something happening?

    Like I said before, a company which profits from athletes being found clean can not be considered impartial.

    I think GBP/Floyd were asked honest questions. Their refusal to provide answers is the suspicious thing.

    I'm not even sure the USADA records are relevant to the countersuit. Isn't this about a statement that Pacquiao made in 2009? I don't think Mayweather was tested by USADA back then and a Google search doesn't bring up anything prior to Mosley.

    You have to take my statement in context. Anyone in a court proceeding can issue a subpena. People in the States have an exaggerated idea of what this is because of congress and television.

    Yesterday Arum lays the groundwork during the Nonito phone interview. We all know he was vaguely referring to the rumors about Floyd. Today the USADA is in court trying to quash a subpena. Arum knew this was coming. Brilliant timing.

    As I said above, at minimum, Floyd's opponents should have full access to the complete test results.

    I remember when floyd lawyer ask the judge to force pac to submit all his medical records as the ones which were provided were not acceptable.

    Floyd lawyer claimed I quote.

    "Pacquiao’s counsel “have only disclosed the names of two of Pacquiao’s doctors. A plastic surgeon in the US and a gastroenterologist in the Philippines. In addition, Pacquiao’s counsel

    Mayweather’s lawyers referred to the “limited number of drug testing results provided” and insisted “that information is insufficient.”



    This is just tit for tat, a story which dates back a while, yet Gabe is pretending as if it some big conspiracy :rofl

    If Floyd has nothing to hide, why not release info? Oh boy it sucks when the shoe is on the other foot, doesn't it?

    Why did Pac lawyers not release all the medical records that floyd's lawyer asked for, so we could have full transparency?

    I think the reason that was rejected was because they were asking for a blanket request for medical records from Pacquiao's camp. You have to specify what records exactly you want to subpeona. I remember reading Pacquiao's counsel saying "why would we be the one to to the leg work for them... they should be the one looking for and acquiring whatever medical records they want...." It's like saying, "I believe you are guilty, you give me evidences to prove it."


    In Floyd's case USADA is the one being sought, not Floyd. There's the difference.

    You didn't answer the question. This is an opportunity for Floyd to show he's very serious about "full transparency" -- something he was so passionate about he turned down the biggest fight in boxing history for years until it was achieved. Now he won't release his own records?

    it does make sense they are in the business of testing athletes, they may also be in the business of making sure an athlete appears clean

    Pac's lawyer is asking for the last 3 USADA tests. USADA filed a motion with these 3 main points.

    First, the requested documents include medical records and documentation relating to Mr. Mayweather Jr., which may constitute confidential medical records requiring his consent and release," the USADA says in its motion to quash. "Further, counsel for USADA has been informed by Mr. Mayweather's counsel that he did not receive notice of the subpoena, as required by Rule 45(b)( 1).

    "Second, the requested documents included documents protected by the attorney client privilege, work product doctrine and/or the investigative privilege.

    "Third, the subpoena purports to require production in Los Angeles, California, more than 100 miles from USADA's offices and the location of the requested documents."

    I actually hope the judge makes USADA hand over the paper work so we can finally put an end to this argument.
