    Yes and no, the case was strong but it would likely have drawn out for at least 2.5 years. the end monetary award would likely have been around 1/4 of what was asked for. So they would have gotten 5-600k or so plus attorneys fees. Not something the defendants were about to sweat in the slightest to be honest.

    The leverage was discovery - that is the phase of a lawsuit where each side can subpeona documents and testimony they can make a pretext as being pertinent. This is what Haymon/SHO were afraid of. Even without accusing them of any actual wrongdoing it wouldnt matter.

    You know how your workplace typically prohibits and discourages salary discussion between employees? Well imagine if details of deals, payment structures, etc started becoming public for a boxing promoter/network/manager. Imagine how many fighters/managers would see things they didnt like, start asking why you treated X this way and me differently. Given the political atmosphere and cutthroat nature of the business you can imagine the fireworks and discontent.

    In short, going into full discovery was a much bigger threat than winning a few hundred thousand to (maybe) a couple million.

    This is not uncommon, and hardly unique to boxing. In fact most lawsuits are launched and settled out of court for this reason. The goal of the litigator is typically to air or threaten to air dirty laundry... not win the actual sum. (most publicized major cases , the sum is a big deal. Most commercial torts actually filed are about the laundry.)

    it was absolutely b.s. none of that **** would have stood in court. they had no signed contract...and gbp's business had nothing to do with her or her company. it was an attempt to throw gbp/schaeffer/haymon under the bus...and it worked. none of that **** held water in court.

    Unless there is a gag order between the two parties preventing them from discussing the financial details of their contract, then Duva's case has no root. A party revealing the financial details of their contract with another party is nothing new in boxing. We've seen it with Mayweather and Pacquiao.

    Duva's so called contract with Stevenson was nothing more than a verbal agreement, no deals were signed. Though in some cases verbal agreement is vied as legal contract, it however very had to prove. Kathy was gonna lose the case and Haymon knew it.

    Honestly I dont know anyone who would be jealous of Ellerbe. Other than maybe you and a handful of Haymon apologists.

    You lost me with the relevance of your first paragraph. Or it appears at least you are mistaken in the details and claims of the actual suit. What Duva was claiming was tortuous interference with her agreement with GYM/Stevenson and HBO, and breach of contract. Not disclosure of financial details, that had nothing to do with it.

    As promoters can , often do, and in the case of Stevenson when the deal was first negotiation GYM in fact did have delegated authority to make deals for boxing contests in the name of Stevenson. If they commit to X conditions in an email, legally its good if the receiving party has reasonable faith and just cause to believe the statement/commitment was made with authority and good faith. Emails have digital paper trails which are actually pretty easy to recover and verify these days (unless your a powerful political appointee with friends in high places looking out for you *coughIRScough*)

    Duvas attorneys had actually crafted a rather nice theory of tort that included a great many parties as co-defendants. The way the case was structured, it was not just possible but likely that discovery would have been awarded. Who knows exactly what would have come out of it, but that process makes the cleanest guys in the world anxious - let alone a promoter, network and shady manager/promoter.

    The case was good. However it would likely not have awarded much money, in the grand scheme of things. (another common misconception is the suit was to force a fight, which isnt true at all. That cannot actually be done. )

    However the case presented with evidence was actually rather good at laying out a prima facie case (or, on the face of it appearing that) Haymon/SHO conspired to induce Stevenson/GYM to break their word and prevent a likely bout between the two boxers. Certainly good enough that documents and testimony would have been required to be subpoenaed to prove the case one way or another about various dealings.

    But again, the award itself would likely have been relatively low. I reiterate, the threat was in giving ME an opportunity to fish for dirty laundry and embarrassing facts about their business practices. Not the actual sum of the settlement. Its rather commonplace occurrence really, you just dont typically see it play out in public like this. The lawsuits that make national news are invariably about huge sums of some sort.
