There's two ways of looking at it

A) Innocent until proven guilty, can't prove his guilt since it was recently banned.

OR

B) A failed test is a failed test and should be treated as such since he can't prove otherwise, no reason he should be failing from a substance from September. Let alone passing the first three tests.
