This opens the way for Stiverne to claim the full purse bid also when he never stepped foot in Russia either. It's an insane decision.
Yeah I already said a few pages back that compensation of some kind is more than fair, just not a full fight purse.
The circumstances are a bit different, since Stiverne tested positive himself. Plus, he's been hesitant to secure a replacement fight, which would give jurors pause when considering a decision to award full compensation.
Time is money, he waste a lot of his time. Time he could have used to fighting a non cheating opponent giving him the full purse
Well here's the thing -- every chance this could have been settled for a million or so, maybe even less, had the Russian promoter made an offer to cover expenses incurred plus maybe a bit more as soon as the fight was canceled over his fighter's failed drug test. Instead, he took a hard line and said, 'We'll pay nothing.' So Wilder had to sue to get ANYTHING. At that point, the stakes go up. Not only has Wilder incurred training expenses, sparring partner pay, setting up camp in England and brining sparring partners there plus travel and hotel and feeding all of them, etc., out of his own pocket, NOW he's had to pile up lawyer fees to fight for his money. And he took a fight for about $3M less than what he would have been paid to fight Povetkin in Russia. So there's the lost compensation issue, through no fault of his own and instead through the wrongdoing of his opponent. So he's the aggrieved part in this and he took the losses. The Russian promoter still made money -- he held the card without the heavyweight fight, collected ticket money (and probably a percentage of concessions, TV rights fees in Russia, etc.). He did his part and the Russian refused to compensate him in ANY WAY, including reimbursement for lost expenses for training, and forced this to go to court. And in court there are two kind of damages: (a) actual, those expenses incurred, loss of income for fighting a lesser fight for lesser money, and (b) punitive damages -- which are by nature designed to punish the offfending party. I say he's due every penny. No reason the Russians should profit by this by keeping money thhat was due Wilder if not for the wrongdoing of the Russian fighter.

Ryabinsky said we'll pay nothing because Povetkin never technically failed any test. I assume this was the reason behind the stance, but then Pov goes and fails another later test which must have coloured this case. It will be appealed I'm sure. Let's establish the absolute facts.
Nothing, but that includes Ryabinsky, too. And the purse money is in escrow, the judge can order it be released to Wilder and there's nothing the Russians can do to step that if it's ordered by a judge.
The facts have been established in a court of law. An appeal would be over procedure -- rulings by the judge, jury instructions, etc. You cannot appeal this ruling based on "Well, look at our evidence again and you'll see our experts were right."
Did they establish the fact that Deonkey never set foot in Russia, and flew home before the fight was even off, and never intended to fight in the first place?
