that is a really touchy subject. Why isn't it premeditated malice? A drunk driver pretty much knows they were going to be a drunk driver that night. They may not have intended to harm or kill, but they did intend to be drunk. That sounds premeditated to me. When i'm drunk driving, i drive real slowww, i may get busted but at 8mph nobody's gonna die
Because malice means intending to harm another living feeling creature. Intending to "get away with" something you're not supposed to be doing - even something grossly irresponsible and dangerous like drunk driving - isn't an act of straight up cruelty. You're not thinking in cold blood about how you want something or someone to feel pain. You're just being an idiot. Drunk drivers deserve to be punished, don't get me wrong - I actually don't even think the penalties in place are severe enough - but mistakes are preventable...malice is just something you have in you or don't (and if you do, you need to be eradicated). **** like animal cruelty is up there with child or domestic abuse...when something is trusting and helpless and you willfully cause it suffering it for kicks or amusement...yeah, you pretty much deserve to be drawn and quartered. I don't give a **** if it is a "cultural thing" or something "kids do all day" (I have serious doubts about Kendall's claim there...if he knows something to that effect he should really be talking to those children's parents or popping them with a 1-2).
agreed on animal cruelty, my g/f is a card carrying PETA member. Agree on all that. And i'm a huge hypocrite to judge drunk drivers. But I guess DUI deaths should be treated like manslaughter or involuntary homicide at the least, unless it's a repeat offense, then it's pretty much murder, or unintentional murder.
