Another point to be made. You have to prove the statement is false AND prove damages. Well if Team Pac successfully proves the statement to be false then all this publicity will benefit Pacman and not damage him. = No Case = No Money for Team Pacman.
1. Proof for #1 is all the drug test that Pac passed since he turned pro. 2. If all words coming from a person's mouth are all opinion, then nobody would have conceived or invented dafamation/slander. Obviously, such an offense exist. I doubt Pac's suit will be anything more than a nuisance to PBF and Golden Boy Promotions. Pac is a world famous athlete is a public figure and as such will be subjected to criticism. This crtiscism is protected by the First Ammendment. None of the Mayweather's ever stated it as a fact that he was on steroids. They have used the disclaimer of opinion and belief. Moreover, what damages has Pac suffered? The Supreme Court declared that the First Amendment protects open and robust debate. A public official or other plaintiff who has voluntarily assumed a position in the public eye must prove that defamatory statements were made with knowledge that they were false or with reckless disregard of whether they were false.
I just read the pleadings and expect to see Golden Boy fire back with a vengeance. The First Amendment will prevail--if this goes to trail I would say that the consequence for Pac will be most damaging.
