Defamation suit lurks as likely roadblock to Pacquiao-Mayweather

    Well known athletes are public figures. It's the "public figure doctrine" not "celebrity doctrine". You need to broaden your scope of what a "public figure" is under the law.

    I already said it, private citizens are not of public interest. The public figure doctrine was created in order to ensure the free flow of ideas/discussion of public issues and topics. Something that is irrelevant to private citizens.

    Think about all that would be said (about private citizens) if you had to prove malice. Malice is almost impossible to prove. People would run around saying whatever the they want. Even if you could prove it false, you wouldn't win.

    1) It doesn't matter how the Mayweathers regard him, he is a sports hero who was considering running for office. He was on the cover of Time magazine. He is a public figure. Period

    2) They made insinuations. And in defamation, they have to make positive statements of fact that they knew to be false.


    Also: Pac has to prove that he was not juicing at the time. He absolutely has to.

    Bull**** lawsuit.

    Floyd doesn't have to prove that Pac was juicing...


    In this case, Pac would have to prove that he was clean. Pac is the plaintiff.

    i say Pac should sue, get that money, fight the Foreman-Cotto winner (which Arum is rooting for Foreman to win), then fight Mayweather

    What needs to happen is that the commision has to step in and either endorse Mayweathers blood testing and bring it into all boxing matches or rubbish them completely. I feel if they dont intervene then this fight will not happen as both guys have fair reasons for not budging on their demands.

    if the Mayweather camp truly believe that Paquaio is on Peds or HGH etc then that is a good enough reason to want blood testing.

    The Pacquaio camp also have good enough reason in refusing the tests if the commision does not think they are necessary as the pac camp are not breaking any rules and are testing negative for PEds according to the authoritys.

    Basically the commision should step in and sort this **** out and then neither camp will have an axcuse to duck the other.

    Go back and do ur own research , 75k is a figure that was used to put it above small claims court,I cannot remember the exact details and I am too tired to look. When the final papers go in they will be after 400 or 500 mil.

    As I said before Pac also has to prove actual malice, which he can't and that's a main reason why public figures don't even bother filing a suit (and the fact it brings more attention to the defamation).

    Not necessarily. Litigation is expensive. As long as the claim is good enough to survive a motion to dismiss, just the fact that the claim is out there can be a big pain in the ass.

    Like I said above, he has a decent actual claim, but there are no damages anyway. He could take this all the way to trial, waste 3 or 4 years and make Mayweather spend a couple hundred thousand in legal fees only to get a moral victory where the court awards him like $10 bucks because Pac didn't actually suffer any damages.

    He has to prove that either they knew the statement was false, or they showed a depraved indifference when making the statements.


    He also has to prove actual damages, in his ability to make money. And this would be entirely speculative.


    Also, something that no one seems to understand is that Pac is caught in a funny-ass catch-22. He claims that he cannot earn to his potential based on the statements of Mayweather, but the only fight that would actually allow him to earn to his potential is with Mayweather. No judge is going to allow that bull**** to constitute "damages" if it's something the defense would have to partake in for it to be part of the plaintiff's earning potential.

    I would be surprised if this claim makes it much further, based on what I know about the details. They are probably in a period of discovery, which can take several months, and be a very expensive process.


    Lately, though, judges have frowned deeply on this whole "litigation by attrition" concept, as it also wastes the court's time and money. If he continues with this, just for a moral victory with little damages, he will likely get it tossed out.

    Whatever you say man. $75K is the only number I have seen published. If he ups it later then I will give him his due. Until then he is using it as a bargaining chip.

    Pac needs to test.
