Con Bent's case was never to prove that he hadn't taken this drug. It was to muddy the waters and find fault in the testing procedures. He knew he'd taken it but he knew that if he could find any fault with any of the procedures that take place he could get away on a technicality. This is a extreme example I'm giving here but OJ Simpson got away with his murder case not because they didn't believe he killed her but it was because there were so many holes and flaws in the prosecution case that the judge and jury had no choice but to let him go because they couldn't prove beyond reasonable doubt that he did do it. Same applies to this rat here. Everyone knows he's been messing with PEDS. We know it. He knows it. Eggie Hearn knows it. Bents lawyers have been instructed to find fault in the testing procedures. Not the actual result. Muddy the waters enough and you will find that enough people will be convinced that there must be some sort of contamination therefore he can't be found guilty of taking the ped. Fckin skumbag. Read his statement he put out. Nowhere does he go into detail about how he could never have taken this drug. He is solely focused on the testing procedures.

And following your example, if this gets to an actual civil court then the burden of proof is relatively low. The lack of appetite for Benn to sue anyone for saying he's a drug cheat probably tells us something. So maybe big balls and expensive lawyers might just give Benn what he wants...
You are not looking at this from a British perspective. Benn is a bigger name here than Pacquiao, not to fight fans obviously but to the casual sport fans he is and a Piers Morgan interview amplifies his reach. Some will hate him and some will warm to him but so long as they are talking about him then it's all good for those crucial PPV and ticket sales.
You can't find faults in the testing procedures. The testing procedures should be flawless making it impossible for an athlete to question them. If they are not flawless and give reason for doubt then there is a major problem.
One of the biggest question marks for me over this 270 page report is, if Benn is claiming there is a fault in the testing system, why aren't more athletes coming forward and claiming the same thing has happened to them? What? The lab only got it wrong in Benn's case and contaminated only his sample? Across different tests, months apart? Sounds like one hell of a coincidence.
