I don't think it is illegal to hold someone down by the throat and applying pressure. As you said; strikes to, and grabs of, the trachea is. Good luck trying to differentiate unless you're the grabber or the grabbee. It'd be near impossible for the ref to tell the difference.
I'm not saying it wouldn't be difficult, but I think the ref may be able to get a close enough look. If you are trying to choke, you would be sending your fingers toward the mat. If you were trying to maim, you would have you fingers closer to the center of the throat, and I would think you would see them trying to sink in.
So what is the answer?? Is grabbing someone around the windipipe with your hand illegal? Or is it legal... but not a smart move in MMA?
If I'm not mistaken, pressing down on the throat isn't a problem. Grabbing the wind pipe like you want to **** it up is.

Grabbing the trachea is illegal. Holding the throat (ie, trying to choke them or hold them without the intention to maim) is probably a bit of a grey area, and is generally ill-advised in most positions, in guard you're asking for an arm-bar or a triangle, in mount you're destroying your base. I've seen guys use it from knee ride (Wand, mini-Rua), but that's about it.
I've seen guys hold the throat with an open palm to hold the guys head still when ground and punding with the other hand. I would imagine that if the guy started going to spleep you'd get pulled off of him and DQ'd or deducted a point or something.
