    The police wouldn't actualy have had any choice about giving it back if they couldnt prove that an offense had taken place.

    The legal position would have been the same as that on confiscationg your meat cleaver or television or whatever.

    When I was training to be a chef I used to take all my knives hime every day because people would break into the lockers, one afternoon I had all my clothes in my bag too and I couldn't zip it closed properly, I walked past this black bloke and then heard a clatter, I looked oer my shoulder to see this guy giving me the strangest look, I glanced down and there was my cleaver on the pavement "Ras!" said he. I picked it up, gave him a Gallic shrug and walked down the road to the pub. Lucky he didn't call the police in hindsight.
