Both fighters would be subjected to the testing, not just one fighter, so I don't see how it's unfair. The meaning was that they can do whatever they wish over and above what the WADA dictates, provided they mean the WADA guidelines. You still haven't addressed the fact that while you claim that NSAC follows the WADA what they really do is use the WADAs list and lab prodecures, but not their full testing regimen, otherwise they would require the same random, any time, no-notification testing that the USADA does. Obviously the NSAC does complies only with parts of the WADA policy. It is the parts they do not comply with that are at issue.
