It's kind of hard to move for summary judgment if you don't even show for depos. A judge would simply slap you down.

Regarding damage from the defamation, this might be the kind of defamation that does not require a showing of actual damage. Truth is there are much better defenses against the suit than challenging Pac to show damages.
