It doesnt have to be written, it can be verbal. The main issue is if it damages hopkins reputation. Pascal could always argue the defence of truth but he'd have to prove it. Otherwise Hopkins can just show it damages his reputation hence his wording "i've been damaged". This is based on UK law but I would hazard a guess that Canadian law is very similar.
