I deal with contracts all day long. The time and place to put the parameters on a deal is prior to drawing up and signing the contract. Hopkins did not refuse to take a test, it was simply not a condition put into the contract by either party. In fact, they have fought twice without enhanced testing, so Pascal's team had two opportunities to ask for it. The fact that they did not request testing in either contract indicates that they did not have genuine concern or belief that Hopkins was using PED's. If I sell a house and do not explicitly say the furniture is included, you do not have the right to demand the furniture right before closing.
