It's not that simple. This isn't a criminal case. It is a civil matter. No judge in their right mind is going to order a drug test because someone bad mouth you. You just better have some damn good evidence to back up your claim.

No lawyer either, but he doesn't have to prove he is clean. He has to prove he was accused and his name was besmirched without evidence.

    Schaefer will answer that:

"Whatever tests they want them to take, Shane will submit to that. We are not going to do other tests than the Nevada commission requires," Schaefer said. "The fact is Shane is not a cheater and he does not need to be treated like one."

I'm no lawyer but was involved in a slander case. Was called in as a witness. I'm by no means an expert in it but the lawyer for the company sueing gave me a really good run down. This was also in Texas.

Their way more liberal out west.

    Precisely.

I'm no lawyer but I'm pretty sure the accusers would have to state their claim as to why they believe the administration of an aberrant testing procedure to be necessary when the accused has no history of wrong doing much less any suspicion of such. This has slander written all over it and Floyd Sr. may have just entered a world of trouble.
