It's a much higher burden of proof to convict someone of a crime ("beyond a reasonable doubt") than it is to deny someone a license ("preponderance of the evidence"). The DA probably didn't think it was enough of an open and shut case to charge them criminally. Specifically, attempted battery has an element of intent. With Margarito claiming he didn't know anything about the wraps, it would have been tough to prove that he had the intent.

Of course, people will probably ignore my post, but this is the answer, coming from a lawyer.

I can see what your saying However as I said if there was a cake like substance and a chunk of it fell off as described by Richardson that would be enough to convict, if there was a chunk that fell off as was said early on there would be NO way for Margarito Not to know....

Thats not even funny in fact its Typical hater ****.... the lady has nothing to do with this yet you want to take a stab at her, like it or not though Margarito disgraced himself and the sport he has never ordered any of his friends to shoot at someone while his kids were with him all becuase that person said he wanted to see him lose.:hi:

Hard wraps...hard evidence ..hard facts...case closed.

"margarito's guilt" is going to be the name of the documentary of his exploits..
he will be 67 years old...and working as a rancher on a chihuahua farm recalling the days he was called the tijuana tornado.. now on weekends ...he goes to tijuana to be a bouncer at a place called tornado's where they have live beastiality acts..

I don't remember Richardson saying anything about a 'chunk that fell off', and he might have been exaggerating. The official testimony says it was harder than it should have been, and that it had elements of plaster. That's enough for me, but might not be enough of a jury of 12 of Margarito's peers in southern California.

The CSAC knows the facts way better than we do, and I trust them to make the right decision about Margarito's reinstatement.

There was nt prosecuter in this process......just a hearing by the CSAC who made the suspension.

After the hearing there was speculation that the California district attorney may prosecute, but it never happened.

......The California district attorney's office must have decided there wa'sn enough evidence to prosecute.

Richardson has changed his story so many times they ought to re name him Hans Christian Richardson with the amount of fairy stories he tells.
First story was he saw plastic inserts fall out. Then it was a plaster soaked pad. What I cannot understand is everyone believes the CSAC who themselves were banned from hol;ding amateur fight due to corruption
