Neither of these points are relevant. 1. Not all performance enhancing drugs are intravenous. 2. There is a difference between "illegal" and "banned by spoting commissions". Some sinus decongestant drugs that you can buy at the drugstore have banned substances in them. If an athlete takes the wrong thing for a cold, they could be breaking the rules. It is part of a PROFESSIONAL athlete's job to understand the rules, and know what is an OK suppliment and what isn't.
The performance enhancer was, at the time, new, undetectable (no failed drug tests even if you had been taking blatantly) and NOT on any banned substances list anywhere. Technically it was legal, but it did break the "spirit" of the rules everywhere for being what it was, a performance enhancer.

EPO was one of the banned performance enhancers that Mosley used. Mosley used the substance in 2003. It's been on banned substance lists since the 90's, maybe even earlier.
