    It is obvious that the intent of the lawsuit was to censor, intimidate and silence the defendants by burdening them with the cost of a legal defense until they abandon their criticism or opposition. Winning the lawsuit is not necessarily the intent of Pac.

    However, by doing so he leaves himself open for a counter suit could make Pac liable for all the defendants legal fees.

    PBF and his associates must first show that the lawsuit is based on constitutionally protected activity. Then, the burden shifts to the Pac to affirmatively present evidence to show that he has a reasonable probability of prevailing on the action. The filing of this special motion by PBF stays all discovery. This feature acts to greatly reduce the cost of litigation to the defendant, and can make beating the motion extremely difficult for the plaintiff, because they effectively must prove their case without the benefit of discovery.
