In March 2010, Golden Boy, De La Hoya and Schaefer filed a motion to dismiss. One of their arguments was that Pacquiao could not deter their constitutional right to speak out freely about a matter of public concern, namely whether the Nevada Athletic Commission should pass stricter drug testing requirements. Today, that argument was rejected by the court without a written opinion. Still under consideration by the court are other arguments from the Golden Boy defendants, and a Mayweather motion to dismiss filed on May 17, 2010.

I see this as part of the fight negotiations. "We'll drop this if you agree to this etc etc" It's on for November IMO. 2011 will end up being a marquee year for settling the long running saga's in the sport.
