Pac has won Round 1 definitely. He won't win the case though. It's not that he doesn't have a good arguement. It's just from a historical point of view, these type of cases never ever wins. Knowing that, Pac still has to go through with the lawsuit. As an up and coming politician and now a congressman, he'll be seen as weak by the Filipino public if he drops the charges now.
Read an article awhile back that GBP CEO Schaeffer "implied" :good on an interview to a Phil. journalist that Pac is taking PED's. Oscar also sent out a blog where he implied that Pac is taking PED's by refusing to agree to Floyd/GBP's demand.
Floyd: "The Philippines got the best enhancement drugs." The quote above by itself (i.e. taken out of context) is innocent and does not implicate Floyd. However, when taken into context, it was indeed Floyd's response to the question by the interviewer on "how Manny came from 106 (pounds) and actually outperformed Floyd against the same fighters Floyd faced in Dela Hoya and Hatton". When connected together, a 10 year old will be able to deduce that Floyd is implying that Pac was able to do those feats by virtue of the Philippines having the best enhancement drugs. Therefore, he is indeed implying that Pac is on performance enhancing drugs. As to what the legal difference is between implication and a direct accusation, i don't know as I am not a lawyer.
