PACQUIAO'S Lawsuit PROVED That PACQUIAO is CLEAN...

Discussion in 'World Boxing Forum' started by What If I Lose?, Sep 25, 2012.

  1. Correct me if I am wrong... but in order to PROVE that Floyd's statements were defamation, Pac had to prove that he was a clean athlete by submitting all of his medical records. Clearly, Floyd was on the brink of losing this case and was advised by his lawyers to settle out of court. And suspiciously, Team Mayweather decided to settle out of court after Team Pacquiao requested that Floyd's medical records be released in the countersuit...

It's only *****'s who believe that anyway. The only reason Floyd said it was to duck Manny.

When a person makes an accusation or an assertion, they are making a statement of fact. According to the ancient methods of Logic developed by the Greeks, the Scientific method and every western legal system, it is then up to the person who makes the statement of fact to prove that fact. Mayweather accused Manny of using PEDS and in doing so he made an assertion of fact. Thus, it was not for Manny to prove that he was "Clean", it was Mayweather's duty to prove that manny had been taking PEDS.

Also, because this assertion was presented as fact and affected Manny's reputation, Manny had the right to sue for libel and provide a legal forum for Mayweather to prove his assertion that Manny was taking PEDS. However, Mayweather's mouth was more than his facts - and Mayweather could not prove that he was speaking the truth when he asserted Pacquiao was taking PEDS. As a result, Mayweather must pay for his lack of facts and the damage he has done to Manny's reputation.

They also have to prove that Floyd said it with the intent of ruining Pac's reputation and Pac has to prove that the statements actually did hurt him

Even if a statement is defamatory, there are circumstances in which such statements are permissible in law.
    Truth
    Privilege and malice

yeah, defense is good. it can get you scot free.

but to settle under a confidentiality clause.

much akin to plea bargaining under criminal cases. :hey
