You dont believe Malignaggi would have a field day in a promotion leading up to a Pac showdown??? That alone would sell the tickets, because Malignaggi in itself the fighter could'nt draw flies even with Pac as the dance partner.
Pac has no case. It is clear as day. There are certain facts you have to prove. And despite the fact that people think Mayweather is a twat has nothing to do with a court of law. First of all... It has to be a statement of fact, and not opinion. Second of all... the person who made them must have known that they were false. Not "should have known" or "should have been suspicious" but they had to have known. Third... The plaintiff has the burden to prove that the statements were actually false. It's not "innocent until proven guilty" like folks claim. With defamation, the plaintiff has to prove that what was said is false. This is an extremely high burden. Fourth... They have to prove actual damages. It has to be proven that there was some type of damages caused by the slighting of his reputation. And as far as most people can tell, the accusations haven't stopped him from making money. His refusal to take the tests and walk away from negotiations has. Whether he walked away out of principal or not, he walked away and wouldn't take the tests. And none of these elements are proven in the complaint. I really don't see how this thing hasn't been dismissed as a joke yet. And I expect Pac's attorneys to be admonished for clogging the judicial system with what could be considered a frivilous reaching complaint.
Get real Charlie.....unless Floyd Mayweather would to come out and literally say, "Pac's a cheating PED user."......Pac does not have a case here. .....asking for random drug testing for a fight is not a cause to sue someone. Mayweather would'nt even have to take the stand on his defense, all the talking would be done by his lawyer. All Mayweather's lawyer would have to do is point out the reasons why Mayweather asked for the testing.....make a case that Mayweather's well being is on the line here as a fighter, and end it with "my client has not at any time directly accused the plaintiff of taking PED's. .....and the case would be thrown out just like that. If Pac does'nt have Mayweather directly stating that Pac is a PED user, there is no case here. ......Malignaggi is absolutely correct, Pac stating he's suing is strictly just to fend off the accusations and the negative that comes with it. They will at one point drop it altogether. This thing is'nt even going to reach the prelim hearing stage.
Malignaggi is a C+ fighter, an old Ricky Hatton gave him the run around - I imagine Khan will KO him in rounds 1-6 and that will be the last we hear about him. I got no respect for someone who seems to be in the news more for mouth off against a great fighter than for what he can do in the ring. And the whole idea of calling Pac a cheat without any proof is starting to leave a very bad taste in my mouth.
It has'nt been dismissed because there actually has'nt even been a preliminary hearing yet.....when a hearing date is appointed to Pac's lawyers, they will wait to the last minute and just notify the court that they are dropping the case alltogether. ......then Pac and team will call a newsconference to announce they have alot of other things on their plate and did'nt want to be bothered with a drawn out court process. .....but be assured that this case will not be heard even in the prelim stage, because the Pac side does not want to publicly be embarrassed with the judge throwing the case out with just hearing the opening statements on both sides.

Thye could get on ESPN, CNN and Fox News and have a joint satelite press conference and make as many suggestions as they like. Until they make an actual statement of fact, the elements of Defamation simply aren't there. And even if he did make a statement, Pac has the burden of proof. Now Charlie is almost completely wrong, but you simply agree with him because he's taking an Anti-Mayweather stance on the issue. None of you guys understand the legal theory behind defamation of character. It's a tough case to prove, it's very tough to prove when the plaintif is a public figure. I went through the same thing with the Shane lawsuit. I argued forever that the guy had no case. It's two years later and nothing of substance has happened with that lawsuit. The same thing will happen with Pacquiao's lawsuit.

Since this incident popped off, Pac has been named fighter of the decade, he fought some no name with no fanbase and the fight was still the 3rd highest attended fight in boxing history, and now he's poised to win a major political election despite being grossly underqualified. Good luck with him proving he's been defamed.
