Should the NSAC change Mosley UD12 DLH to DLH NC/DQ Mosley? (new info on BALCO case)

According to grand jury transcripts, Shane Mosley testified that the he used and was aware of using EPO as he injected the illegal substance into himself in 2003. For more info please visit the NY Daily News’ website (Sport section, main headline) as I can't copy+paste the article here.

Of course he used EPO before the 2nd Oscar De La Hoya fight, and testified using after it, when the BALCO scandal broke out (but his testimony was under protective order until last week). In the fight Mosley won by (controversial) unanimous decision, showing exceptional conditioning, speed and reflexes despite the fight being at 154.

Since Mosley himself admitted using EPO (Erythropoietin is a protein hormone produced by the kidney, but also an absolutely forbidden performance enchasing drug, it's on the WADA and every anti-doping list), I think the question of the topic is very alive and important. Under no circumstances a boxer should get away using illegal substances, especially if a winning performance is the result. Of course it’s almost impossible to measure the effects in % of the winning performance, but the hard fact still remains as hard evidence and court testimony, so the world of boxing, including us, fans, cannot deny this case.

But 5 years later, should the Nevada State Athletic Commission change the 2003 fight result from Mosley UD12 De La Hoya to De La Hoya NC (no contest) or even DQ (disqualify) Mosley?

Of course after some James Toney and Mike Tyson fights, when post-fight drug tests showed illegal substances in their blood, the local commissions made the change to NC. Sometimes the rules are more serious and the result is changed to DQ or stripping of the title. Some other, non doping related results were changed years later like Julio Cesar Chavez’ DQ loss to Miguel Ruiz (visit boxrec for more info).

So the question is going to the public poll. Should the NSAC
    A) leave the result alone despite being evidence and court testimony of Mosley using EPO and admitting he injected into himself?
    B) change the result to NC, of course meaning Mosley’s LMW title achievements being taken away?
    C) change the result to a DQ win for De La Hoya, meaning no LMW titles and another loss in Mosley’s record?

"Forget it already" or "who gives a f*" or "leave Shane alone" is not an answer, well, not in my thread. Post only if you have an opinion on the case and vote only if you are confident in your answer. Thank you.

IMHO Mosley lost that fight anyways, the Commission should do the right thing and award the actual winner of the fight his over due W and they should also fine Mosley and suspend him to be honest. no special treatment should take place here.

I've said since last year, when Mosley admitted to have "unknowingly" taken steroids, that it should be a no-contest.

The difference between Mosley and someone like James Toney is that Mosley went to a place where the drugs were supposed to be undetectable, while the genius Toney used Deca, which stays in your system for awhile.

Much as I have enjoyed Mosley's career over the years and like the dude he always comes over as humble and down to earth. You gotta do whats right and change the result in DLH's favour.

He cheated and the truths out. Will be interesting to see what commission does with this case. Lets see if double standards prevail.....

One thing about it though is, if you change it to a No-Contest and Mosley never wins that fight (and the titles), what happens to Winky Wright's titles that he won from Mosley a few months later?

It kind of makes things weird.

lol this aint new admissions from Mosley. Its just being brought back up because Barry Bonds is on trial and Shane has been called in.

HE'S ALREADY SAID HE TOOK EPO. He's also already said he didnt know it was illegal.

    This information IS NOT NEW.

He testified in court that "BALCO founder Victor Conte explained in detail how the drug was used and what its effects would be, including the potential harmful effects of the highly-regulated endurance booster."

You and your trainer decide to use intravenous 'supplies' for your training. You and your trainer choose EPO. They explain what it is, how it works, what harms does it do. You inject it into your system...

... and you don't even think what you are doing might be illegal?

The new info here is the transcript of court testimony.

Mosley lost that fight anyway, one of the two decisions Oscar was on the wrong end of. A gift over Sturm can't make up for a wrong decisions against Shane Mosley.

He should be fined, and perhaps suspended. As was Toney and Vargas.

In the opinion of many (probably most) Shane lost the fight anyway. This just clinches it.

I have the Oscar and Shane 1-1 alltime.

In regard to changing the official result, I would hesitate to do that as a lot of time has gone by and it would affect subsequent title lineages.

Probably leave it as a W for Mosley with an asterix in the margin and some clarification at the bottom of the page.

Oscar's had more questionable decisions go his way than against it.
