No, it doesn't "dictate" that at all. Are you kidding? The person who elects to get behind the wheel is the one and only one responsible for their actions. A more inebriated person riding shotgun can be said to be responsible for risking their own safety (and, as it happens in this case, spent the whole time pleading with the driver to stop and pull over & reconsider, not that you even need to know the details to refrain from what is essentially victim-blaming)
