    Wow *****s are recycling their bull**** again. This was already discussed back in early 2009-2010. Same as Pacquiao's defamation lawsuit.

    pacquiao prays for judgement against defendants as follows:

    1. general and special damages in an amount to be proven at trial in excess of $ 5,000,000.

    2. presumed damages based on harm to pacquiao's reputation.

    3. punitive

    4. attprney's fees.

    5. all costs of suits incurred herein.

    Nobody has to reach. He sued to make them drop the testing which is why he still hasn't taking the test or dropped the lawsuit.

    If he takes the test all of these questions would not still be in the air.

    I think Floyd beats his ass even on Steroids, but I am not the one that has to risk my health so i cant blame him for demanding the test

    Wrong. And Smith didn't have to be named. His organization was, and he was the person (or, apparently, at least the key person) in that organization who wrote about the supposed email:

    The above statement is from Pacquiao's lawsuit.

    So: Charge of sending the email denied, in Pacquiao's defamation suit

    And: Tim Smith's employer named, and he is the person -- or at least the primary person, by all accounts -- who wrote about that matter for the New York Daily News. That is, he is the person who "published these false statements."

    But, Tim Smith isn't a publisher. He's a writer. So you don't name him, you name the entity who actually published the "false statements." They're the culpable party, so to speak.

    ). With one caveat: The person(s) who supposedly wrote the email (or whom Marley seems to think wrote the email) weren't authorized to write it. So, though he/she/they may be members of Team Pacquiao, the upshot is it didn't come from a legitimate source.

    For example, if my 5-year-old daughter writes an email to the governor of my state saying that she demands all the trees in the state be painted pink, then someone could say "hey, that guy's family sent an email to the governor demanding that all the trees be painted pink." While that is factually true, it's misleading. No one would think that my 5-year-old is going to be counted on to accurately reflect the feelings of the entire family nor be able to present herself in an adult, responsible manner to the governor.

    highlighted material has already been dealt with as regards Tim Smith and the New York Daily News. I would imagine ESPN (Atlas' boss) may have been mentioned in a similar capacity in the suit, but I'm not sure.

    My guess is that Pacquiao and his lawyers want to focus on those individuals whom they believe are the most responsible for the alleged defamation. As in, those people whom Team Pacquiao may feel were Smith's and Atlas' source or sources. If you want to take down a tree, you go after the roots, not the branches.

    This thread is a good example, I think, of exactly why Pacquiao filed the defamation suit. Half-truths and flat-out wrong statements get treated as accurate, when they're not. No one can be expected to remember the entire course of events, particularly not the paying public, whom Team Pacquiao obviously feels has come (or some of the people in the public, anyways, if not all of them) to see Pacquiao's reputation in a diminished light.

    As reputable as Floyd right... who spread the accusations about PAC without providing a shred of proof to support those damaging comments....Who also posted a link to the "ex sparring partner" story....who also backed this whole email that mysteriously still has yet to surface anywhere. If someone had it....it would have made itself into the hands of the media by now....
