Yes, he was defamed. The burden of proof lies on the plaintiff in terms of proving the allegations aren't true, but not necessarily that it cost him a certain amount of money; an inferior image is the commonly understood necessary outcome, and that's what resulted.

Not 100 percent sure, depending on the common law precedent which I'm not familiar with, but that's my understanding of it. Apparently it's to prevent the person's general well-being. As a deterrent, that reasoning makes sense, otherwise you got people saying all sorts of **** about each other that doesn't directly impact their financial well-being but could make their lives much more difficult. So Manny doesn't really have to prove he lost money from it, just that the claims are false and make him look inferior to his prior image.

 

I was under the impression that Pacquiao accused the Mayweathers of defamation and slander. That's why I believed he would have to prove financial loss. If it's just defamtion, then I think all Pacquiao has to prove is that he said it. And since he never tested positive for anything, he would win.

the courts need not search much. all we need to do is send a link to this forum and key in words on the search bar for "nah, im not buying pac's PPV". they'd find tons here.
