In big companies like HBO, lawyers can do what they want without permission for smaller lawsuits/legal issues. They likely didn't need to get permission from the HBO heads to do this. Things like this occur because lawyers have an obligation to protect their IP. For example, if they didn't pull 24/7 off of youtube ever, it could eventually become public domain, and 24/7 and things related to it lose their copyright... It's bull**** but it's a protective measure all corporate lawyers take. Things like this pop up all the time. For example, some kid made some Gears of War dolls, and got sued by Epic Games. The company then apologized saying that the lawyers were acting on their own and have to protect their IP.
