    According to what i'm reading, the White House have now "referred the question about Johnson to the Department of Justice." What appears to happen is that the President can just go "hell yes! Pardon!" But, as with so many other questions, he takes advice.

    In this case from the Justice Department.

    Who are desperately stretched for resources in this specific department.

    Resources again.

    “It is the department’s position that the limited resources which are available to process requests for president clemency – now being submitted in record numbers – are best dedicated to requests submitted by persons who can truly benefit from a grant of the request,” pardon attorney Ronald Rodgers wrote to King in December 2009.

    The quoted paragraph stresses that resources in the area of pardons are stretched. In other words, only so many pardons will be considered. This means that if Johnson's pardon is considered, the pardon of someone living and possibly in prison now will be delayed.

    That's if the justice department were expected to be the main party to deal with this.
    They aren't. Obama is.

    I give you credit for finding the JD refer to resource issues.
    But they were never meant to be the decision maker on this.

    Obama is the one to decide.

    They asked the JD as a formality as part of the process, and the JD stuck to their policy. All to be expected.

    I'll say the same thing again:

    Obama can grant the pardon. But he takes advice. He's asked for that advice from the US Justice Department. That seems to be normal.

    Yeah it's very normal. We just shouldn't expect a different response from the JD.
