Burns was not paid as per the agreement. He made a decision to walk away. As anyone who has studied contract law will know, it is extremely complex and Burns was judged to have breached the contract because his original agreement with Fisheyes did not stipulate terms of payment as being an essential part of the agreement.

In effect despite the judge acknowledging that Burns was owed the money and had been for some considerable time, the decision to walk away was not valid.

****** said in a phone call on the 18th of December that he would pay the outstanding balance of £102,000 by the 20th of Jan and would personally guarantee it irrespective of the fact his company FWP was going under.

Again Burns team at the time made a mistake by not making this a legal contract.

A part-payment was made late on the 6th of Feb and then nothing more. Burns team then sent the letter that was "signed" (Ricky claims and the judge agrees that he didn't sign it) on the 6th of March to say their promotional deal was now ended as a result of non-payment.

The key part of the judge's summary is when he states that he felt that non-payment as of the 6th of March did not represent a repudiatory breach. Ricky shot himself in the foot at this point by saying he terminated due to continued cancellations of fights as much as the non-payment.

The judge's summary then goes on to slate FW and his fanciful predictions on profit, etc. They claim they made £300k profit on the Burns - Mitchell fight, however the reality is that the show lost money as that £300k came from BN, which Frank owns.

He also rejects FW's claims that had Burns not left FWP would have remained solvent. He regularly used the words "unrealiable" and "untruthful" to describe FW.

The judge then says that on the balance of probabilities FWP has suffered no loss from not continuing to promote Mr Burns.

The money Burns owed was due to unpaid commission from management fees. 25% was due to be split between FW and Alex Morrison. Morrison took his 15%, whereas FW deferred his until they got into bigger fights.

FW owed Ricky £102,000 plus interest, however this was due from FWP and Burns was therefore never to receive it as a result of FW liquidating the company.

The reality is that FW was the scumbag who didn't pay Ricky and was doing his utmost to avoid paying money he owed. Ricky took the decision to leave but under contract law this turned out to be incorrect.

Ricky went bankrupt as a direct result of FW's. Yet, FW to this day has not been sanctioned by the board over his behaviour.

It's sickening.
